Terms of service

This website is operated by Leonard Irimia, trading as PESALUX. Throughout the site, the terms "we", "us" and "our" refer to Leonard Irimia, trading as PESALUX. A company (IDEM UNIVERSAL WORKS) is in the process of being registered; these Terms will be updated with its full legal details as soon as registration is complete.

By placing an order on this site you agree to these Terms. Please read them together with our Privacy policy, Refund policy and Shipping policy, which form part of them.

1. Who we sell to

We sell to customers with a delivery address in the European Union. You must be at least 18 to place an order.

2. Products

We sell the VITAL-IQ smart body-composition scale and its accessories. Product images are as accurate as we can make them; small differences in colour can occur on different screens. VITAL-IQ is a wellness device for personal use. It is not a medical device, and its readings are not medical advice.

3. Prices and payment

All prices are in euro and include VAT. Shipping within the EU is free. Payment is taken at checkout through the payment methods shown there. We do not store your card details.

4. Your order

When you place an order we send an order confirmation by email. The contract is formed when we dispatch your order and send the shipping confirmation. We may refuse or cancel an order if the product is unavailable, the price was shown incorrectly, or we suspect fraud. If we cancel, we refund you in full.

5. Delivery

See our Shipping policy. Risk of loss passes to you when the product is delivered to you.

6. Returns, withdrawal and refunds

See our Refund policy. Consumers in the EU have a 14-day right of withdrawal, and we add our own 30-day money-back guarantee on top of it.

7. Guarantee and warranty

As a consumer in the EU you have a legal guarantee of conformity of 2 years from delivery. In addition, VITAL-IQ carries our 2-year warranty against hardware defects, as described in the Refund policy.

8. Liability

Nothing in these Terms limits any liability that cannot be limited by law, including for death or personal injury caused by negligence, or your statutory rights as a consumer. Beyond that, we are not liable for indirect losses, or for losses that were not foreseeable when you placed your order.

9. Your account and this website

You are responsible for keeping any account details safe. You must not misuse the site, copy its content, or use it for anything unlawful.

10. Changes

We may update these Terms. The version shown on this page when you place an order is the one that applies to that order.

11. Governing law

These Terms are governed by Italian law. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts of that country.
